المسؤولية الجنائية الناشئة عن الاعتداء على أراضي الغطاء النباتي : دراسة تحليلية في ضوء نظام البيئة السعودي

Abstract

مشكلة الدراسة: أن الاعتداء على البيئة خصوصاً الغطاء النباتي أصبح يشكل خطراً كبيراً، وهذه الاعتداءات لازالت مستمرة وتأخذ أشكالاً وصوراً متعددة، ويشكل ضعف الوعي في بعض الأوساط مشكلة لابد من وضع حلول لها فكان لزاماً في تدخل المنظم لتشديد تدابير الحماية للبيئة ومنها الغطاء النباتي وأراضيه، لذا حاولت من خلال هذه الدراسة إبراز المسئولية الجنائية والمخالفات والعقوبات المرتبطة بالغطاء النباتي وأراضيه مع بيان السلطات المختصة بضبط هذه المخالفات وملاحقتها واستخدمت المنهج الوصفي الاستقرائي التحليلي.

أهداف الدراسة: تهدف الدراسة إلى بيان مفهوم الغطاء النباتي، وتحديد مفهوم الجريمة البيئية المرتبطة به، وبيان أركان الجريمة البيئية، وبيان أنواع الجزاءات المرتبطة بالاعتداءات على الغطاء النباتي وأراضيه، وإيضاح القواعد الإجرائية لضبط وملاحقة المعتدين على الغطاء النباتي، وبيان جهات الفصل في تلك الاعتداءات.

أهم النتائج: برز من خلال الدراسة اهتمام المملكة العربية السعودية المبكر بكل ما يتعلق بالبيئة خصوصا الغطاء النباتي الذي تعتبر المملكة من الدول التي هي في أمسّ الحاجة إليه، كما تم التعرف على أنواع الاعتداءات التي يمكن أن تطال الغطاء النباتي وأراضيه، ومعرفة تفاصيل كل جزاء لكل اعتداء.

أهم التوصيات: ضرورة نشر الوعي وزيادته لدى المواطنين والمقيمين بأهمية الغطاء النباتي وضرورة المحافظة عليه وأن تتولى وسائل الإعلام دورها في تثقيف الناس، ونشر الأنظمة البيئية، ونشر العقوبات المقررة على الاعتداءات البيئة، وإدراج مقرر في مراحل التعليم عن أهمية البيئة، وعن عقوبات الاعتداء عليها، كما أوصى كذلك بتنويع الجزاءات والتوسع في الجزاءات الإدارية ومنها المعاقبة بمنع السفر، وعدم منح تأشيرات عمالة رعاة للمخالفين، وإدراج عقوبة الإيقاف للمخالف ولو كانت مدتها قليلة.

Research Problem: The attacks on the environment, especially vegetation, have become a major threat. These attacks continue and take many forms and images, and the lack of awareness in some milieu is a problem to be resolved, so it is necessary for the intervention of the organizer to tighten the protection measures for the environment, including vegetation and its lands. I tried through this study to highlight the criminal responsibilities and violations and penalties associated with vegetation and its lands and specify the responsible authorities to control and prosecute these violations and used the descriptive, inductive, and analytical approach.

Study Objectives: The study aims to clarify the concept of vegetation, define the concept of environmental crime associated with it, clarify the elements of environmental crime, indicate the types of penalties associated with attacks on vegetation and its lands, clarify the procedural rules to control and prosecute the aggressors on the vegetation, and specify the responsible authorities that take actions against these attacks.

Main Results: Through the study, the Kingdom of Saudi Arabia has been involved early in everything related to the environment, especially the vegetation because it is considered one of the countries that are in need of it. Besides that, the types of attacks that can affect the vegetation and its lands have been identified, as well as the details of each penalty for each attack.

Main Recommendations: The necessity of spreading and increasing the awareness among citizens and residents of the importance of vegetation and the need to preserve it was concluded. The media should take over its role in educating people, spreading environmental systems, and the penalties prescribed for environmental attacks. Introducing a course in education about the importance of the environment and the penalties associated with the attacks should be considered. Also, the study recommended diversifying the penalties and expanding them to include a travel ban, preventing violators from obtaining worker visas, and detaining them even for a short period.
