مُشكلة الدِّراسة: تتجلَّى مُشكلة الدِّراسة في الانتشار الواسع لجريمة التَّجسُّس على البعثات الدِّبلوماسيَّة والتَّطوُّر السَّريع الذي يُصاحبها مُواكبًا للتَّطوُّر في ظلِّ عدم وجود نُصوص قانونيَّة صريحة خاصَّة بجريمة التَّجسُّس على البعثات الدِّبلوماسيَّة وأثرها على العلاقات الدَّوليَّة بين الدُّول.
منهج الدِّراسة: سوف تعتمد الباحثة في دراستها على المنهج الوصفي التَّحليلي الوصفي من خلال وصف وتوضيح الجريمة محلِّ الدِّراسة وبيان تعريفها وصورها، والمسؤوليَّة الواقعة نتيجة القيام بها وبيان أثرها على العلاقات الدَّوليَّة، والتَّحليلي عن طريق تحليل النُّصوص القانونيَّة في الاتِّفاقيَّات والمُعاهدات الدَّوليَّة والإقليميَّة المُرتبطة بالمُشكلة موضوع الدِّراسة.
الهدف الرَّئيس للدِّراسة وأهمِّيتها: 1- تسليط الضَّوء على ماهيَّة جريمة التَّجسُّس على البعثات الدِّبلوماسيَّة والمسؤوليَّة النَّاشئة عنها. 2- التَّعرُّف على أثر الجريمة على العلاقات الدَّوليَّة وطُرُق تسوية النِّزاع الحاصل نتيجةً لها.
أهمُّ النَّتائج: 1- جريمة التَّجسُّس على البعثات الدِّبلوماسيَّة جريمة عُرفيَّة في المُجتمع الدَّولي، فلا يُوجد قواعد قانونيَّة تنصُّ على تجريمها، ولكن اقتضى العُرف بين الدول على تجريمها لما تخلقه من زعزعة للسِّلم والأمن الدَّولي. 2- افتقار الاتِّفاقيَّات والمُعاهدات الدَّوليَّة بنصوص تختصُّ بجريمة التَّجسُّس على البعثات الدِّبلوماسيَّة. 3- تؤثر جريمة التَّجسُّس على البعثات الدِّبلوماسيَّة على العلاقات الدَّوليَّة نظرًا لمساسها بالعلاقات الدِّبلوماسيَّة بين الدِّول.
أهم التَّوصيات والمُقترحات: 1- العمل على إيجاد اتِّفاقيَّات أو مُعاهدات دوليَّة تختصُّ بجريمة التَّجسُّس على البعثات الدِّبلوماسيَّة. 2- إنشاء جهة قضائيَّة دوليَّة مُختصَّة بدعاوى المسؤوليَّة الدَّوليَّة الجنائيَّة للأفراد في الجرائم التي لا تختصُّ المحكمة الجنائيَّة الدَّوليَّة بها. 3- دراسة الحجيَّة القانونيَّة لأدلَّة الاتِّهام والبراءة المُستقاة عن طريق التَّجسُّس على البعثات الدِّبلوماسيَّة وإمكانيَّة استخدامها كدليل لإدانة الدولة المُعتدية. 4- دراسة مسؤوليَّة الدِّول عن جريمة التَّجسُّس عبر الأقمار الصناعيَّة.
Study Problem The Study's Issue manifests itself in the widespread crime of spying on diplomatic missions and the rapid development that follows it in the lack of defined legislative texts connected to the crime of spying on diplomatic missions and its influence on international relations between countries.
Study Approach: The researcher will use the descriptive analytical approaches in her study. The descriptive approach through describing and clarifying the crime under study and stating its definition and images, the responsibility that occurs as a result of doing it and its impact on international relations, and the analytical approach by analyzing the legal texts in international and regional agreements and treaties related to the Issue subject matter of the study.
The Study's Primary Objective and Significance: 1. shedding light on the nature of the crime of spying on diplomatic missions and the resulting responsibilities 2. Understanding the impact of the crime on international relations and strategies to resolve the dispute that resulted from it.
The Most Significant Results: 1. The crime of spying on diplomatic missions is a customary crime in the international community, as there are no legal rules that provide for its criminalization, but custom among countries requires it to be criminalized because it creates a disturbance in international peace and security. 2. The lack of international conventions and treaties to texts relating to the crime of spying on diplomatic missions. 3. The crime of spying on diplomatic missions affects international relations because it affects diplomatic relations between countries.
The Most Essential Recommendations and Suggestions: 1. Investigating international treaties or agreements connected to the crime of spying on diplomatic missions. 2. Establishing an international judicial organization specializing in situations of worldwide criminal liability of people for crimes not covered by the International Criminal Court's authority. 3. Investigating the legality of evidence of accusation and innocence gained by spying on diplomatic missions, as well as the feasibility of utilizing it to prosecute the aggressor country. 4. Investigating governmental accountability for spying through satellites.
