مشكلة الدراسة: تتمثل مشكلة الدراسة في معرفة طبيعة نقل العدوى والاخطار التي يمكن ان تسببها والتعرف على الإجراءات القانونية المتمثلة في إذا ما كان هنالك عقوبات تفرض على الجرائم المتعلقة بنقل العدوى ومسؤوليتها الجنائية.
منهج الدراسة: استخدم الباحث ثلاث مناهج في رسالته وهي المنهج الوصفي والمنهج التحليل والمنهج المقارن.
أبرز النتائج: 1. هنالك قصور قانوني لدى كثير من الدول في عدم وجود قانون خاص يتعلق بنقل العدوى والآثار القانونية المترتبة عليه. 2. تتحقق جريمة القتل العمد بنقل العدوى بفيروس كورونا وفقًا لأحكام الشريعة الإسلامية. 3. تتحقق جريمة القتل العمد بنقل العدوى بفيروس كورونا وفقًا لأحكام القانون الوضعي.
أبرز توصيات ومقترحات الدراسة: 1. تشكيل لجنة من المختصين قانونيًا في كل دولة للبحث أكثر، حول الجانب القانوني المتعلق بجرائم نقل العدوى بشكل عام ونقل العدوى بفيروس كورونا بشكل خاص. 2. نوصي بضرورة وجود قانون خاص بنقل العدوى في كل دولة، يوضح كافة التفاصيل القانونية للتصرفات التي من شأنها أن تتسبب بالتعدي على حياة وصحة الآخرين بنقل العدوى. 3. نوصي الباحثين القانونين في البحث حول ما يتعلق بنقل العدوى بفيروس كورونا المستجد بالنظر إلى وصفها جريمة شروع في القتل. 4. نوصي الباحثين القانونين في البحث أكثر في ما يتعلق بنقل العدوى بفيروس كورونا بوصفها جريمة قتل شبه عمد.
Research Problem: The problem of the study is to know the nature of the Corona virus and the dangers that it can cause, and to identify the legal procedures represented in whether there are penalties imposed on crimes related to the transmission of infection and their criminal responsibility.
Study methodology: The researcher used three approaches in his thesis, which are the descriptive approach, the analytical approach, and the comparative approach.
The Most relevant results: 1/ There is a legal shortcoming in many countries in the absence of a special law related to the transmission of infection and the legal consequences thereof. 2/ The crime of premeditated murder by transmitting infection with the Corona virus is realized in accordance with the provisions of Islamic Sharia. 3/ The crime of premeditated murder by transmitting infection with the Corona virus is realized in accordance with the provisions of positive law.
The most important recommendations and suggestions of the study: 1/ Forming a committee of legal specialists in each country to research more, on the legal aspect related to the crimes of transmission of infection in general and transmission of infection with the Corona virus in particular. 2/ We recommend the necessity of having a law relating to the transmission of infection in every country, which clarifies all the legal details of the behavior that would cause an infringement on the life and health of others by transmitting the infection. 3/ We recommend legal researchers to research what is related to the transmission of infection with the emerging corona virus, given that it is a crime of attempted murder. 4/ We recommend legal researchers to investigate further the transmission of MERS-CoV as a quasi-involuntary homicide.
