المسؤولية الجنائية في الاستخدام السلمي للطاقة النووية

Abstract

مشكلة الدراسة : تنحصر في التساؤل الرئيسي : ما المسؤولية الجنائية عن سوء الاستخدام السلمي للطاقة النووية؟ منهج الدراسة : تم استخدام المنهج الوصفي بطريقته العلمية القائمة على الاستقراء والتحليل. أهداف الدراسة: 1- التعرف على الطاقة النووية والمجالات السلمية لاستخدامها. 2- معرفة الاضرار التي قد تنتج عن هذه الاستخدامات للطاقة النووية للاشعار بخطورتها. 3- تحليل المسؤولية الجنائية المترتبة على الاضرار الناتجة عن الاستخدام السلمي للطاقة النووية. 4- التعرف على موقف القوانين الدولية حيال الاضرار الناتجة عن الاستخدام السلمي للطاقة النووية. 5- معرفة العقوبات المترتبة على الاضرار الناتجة عن الاستخدام السلمي للطاقة النووية. أهم النتائج : 1- يكون انتاج الطاقة النووية من عملية انشطار الذرة أو اندماج الذرات وقد أكدت الدراسات أن اندماج الذرات أفضل من انشاطارها في قلة المخاطر الناتجة. 2- إن الطاقة النووية رغم عيوبها لها من المزايا ما يمكنها من أن تكون مصدراً يمكن التعويل عليه خاصة أنها آمنة ووفيرة ونظيفة مقارنة بالمصادر التقليدية من نفط وفحم المسببين لما يعانيه العالم اليوم من تفاقم لأزمة تلوث البيئة. 3- إن الطاقة النووية إذا حسن استخدامها، ستكون البديل الأمثل لمصادر الطاقة التقليدية. 4- الطاقة النووية تسهم اليوم فيما يزيد عن 18% من استهلاك الطاقة الكهربائية عالمياً بالأضافة الى حل الكثير من المسائل الصحية والصناعية والزراعية. 5- إن الطاقة النووية صعد نجمها بسبب الاهتمام العالمي لمشاكل البيئة والاحتباس الحراري وارتفاع درجة حرارة الكون فتتوقع الدراسات القائمة حاليا ان تكون صناعة الطاقة النووية هي الخيار الامثل مع نهاية هذا القرن لتحقيق التنمية الاقتصادية والاجتماعية في ضمان حماية البيئة، وقد تكون هي الأداة الافضل لإنجاز كافة البروتوكولات الخاصة لحماية البيئة. 6- إن أكبر الآثار السلبية على البيئة، النفايات والمخلفات الناتجة عن المفاعلات النووية اضافة الى الحرارة الناتجة عن تشغيل المحطات النووية المستخدمة فيها الماء للتبريد. وهذان الجانبان إذا لم يتم حلهما جذريا سوف يبقيان حجر عثرة أمام تكنولوجيا الطاقة النووية. أهم التوصيات: 1- سرعة اصدار نظام جزائي سعودي ينظم المسؤولية المترتبة على الأفعال الضارة والخطرة الناتجة عن التعامل مع الطاقة النووية وانتاجها والتخلص من نفايتها ونقلها. 2- مشاركة المختصين في علوم الطاقة النووية في سن القانون النووي كونهم أعلم بمخاطرها.

College of Criminal Justice Department: Sharia and Law STUDY ABSTRACT Study Title: Criminal liability in the peaceful use of Nuclear energy Prepared by: Mansur Yousef Al Sisi Advisor: Dr. Abdel Fattah Walad Babah The problem of the study: is summarized in the main inquiry: Is there a criminal responsibility for the peaceful use of nuclear energy? Approach of the Study: The descriptive approach is used in its scientific way which is based on extrapolation and analysis. Objectives of the study: 1. Identify the nuclear energy and its peaceful use and applications. 2 . Knowing the damages that may result from these applications of nuclear energy to realize its dangers. 3. Analysis of criminal liability for damages resulting from the peaceful application of nuclear energy. 4. Identify the reaction of international laws regarding damage resulting from the Peaceful use of nuclear energy. 5. Knowing the sanctions of damages resulting from the peaceful application of nuclear energy. The most important results: 1 - The production of nuclear energy as a result of the process of atom’s splitting or atom fusion. Studies have confirmed that the fusion of atoms is better than fission in reducing the resulting risks. 2- Nuclear energy, despite of its disadvantages, has many advantages that can enable it to be a reliable source, especially as it is safe , plentiful and clean compared to the traditional sources of oil and coal which are the sources of suffering that make the world today is exacerbated by the crisis of environments pollution. 3 - If we properly use the nuclear energy, it will be the perfect alternative to traditional energy Sources. 4- Nuclear energy contributes to more than 18 % of electricity ' s consumption globally , as well as solving lot of health , industrial and agricultural issues. 5 - The nuclear power became so popular as a result of the world concern of environmental issue and global warning and high temperature of the universe. The existing studies predict that the nuclear power industry will be the best option by the end of this century to achieve the economic and social development in ensuring environment protection and may be the best tool of completion of all protocols for the protection for the protection of environment 6 - The biggest negative effects on the environment, the waste and remains from nuclear reactors as well as the heat generated by the operation of nuclear plants, which use water for cooling. Those two problems, if we do not resolve them fundamentally, they will stay a stumbling block to the technology of nuclear energy. The most important recommendations : 1- Issuing a Saudi nuclear law quickly that regulates the liability based on harmful and dangerous actions resulting from dealing with nuclear energy and its production, disposal of its wastes and transfers it. 2- Participation of specialists in science of nuclear energy to issue a nuclear law because they are the only category who knows its dangers.
