المقارنة القانونية ودورها في تجويد الرسائل والأطروحات العلمية

Abstract

من بين المقاربات المنهجية المختلفة التي تُستخدم في مناهج البحث العلمي المقارنة، وهي تمكّن من بيان نقاط الاختلاف والاتفاق والتنوع بين مادتين أو أكثر. وفي مجال البحوث القانونية خصوصًا، وتحتل المقارنة مكانة مهمة؛ إذ أسهم استخدامها لإعداد البحوث القانونية في بلورة وصياغة ما يسمى اليوم بالقانون المقارن. ويبدو من الضروري مساعدة الباحثين في جامعتنا عى الالتزام بفنية منهجية المقارنة القانونية لاستخراج نقاط الاختلاف والاتفاق والتنوع الموجودة في المواد والتشريعات محل الدراسة ومعالجتها؛ لضمان مستوى مقبول من الجودة للبحوث العلمية في مجال الدراسات المقارنة، ويتعين هنا مساعدة الطالب على تخطي العقبات وتجاوز مختلف مراحل إعداد البحث بدءًا باختيار الموضوع ومرورًا بوضع الخطة وكتابة المقدمة، ووصولً إلى تحليل الخطة، وانتهاءً بكتابة خلاصة للتحليل.

Comparison, per se, is one of the methodological approaches used in comparative research methodology. Essentially, it explains points of concurrence, divergence and variety between two or more courses of study. However, in the area of legal studies, in particular, comparative approach is significant. It is employed in the preparation of legal researches and drafting what is called comparative law. Researchers at our university should be assisted with the adherence to the art of comparative law methodology. The latter will result in deducing various points of agreement; points points from the studied articles and legislations of disagreement; and points of variety. Such points will be addressed in order to guarantee producing qualitative researches in the broad area of comparative studies. However, the student should be assisted in overcoming obstacles and passing all stages of preparing the research. Research stages begin with the selection of research subject, drawing up the symposia, writing an introduction, analyzing the plan, and concluding with the presentation of an analytical summary.
