The present research strives to identify broad concept of “right” and its typology. All in all, it offers three-fold categorizations as under: - Right of Allah Almighty in exclusive terms. - Joint right _____ right of Allah and the right of the human-being. In this situation, right of Allah is predominant. - Joint right _____ right of Allah and the right of the human-being. In this context, the right of the human-being reflects dominance. Next topic of significance expounded in the present research is the concept of Al-Qazf (false accusation). Pursuant to this discussion, the research has identified conditions relative to the implementation of had penalty for Al-Qazf (false accusations). The research includes in its presentation divergent viewpoints of variant jurists. Pertinent rationales are presented to support respective opinions. In its conclusive judgement, the research expresses that had action in Al-Qazf (false accusation) is a joint right _____ the right of Allah and the right of the human-being. Nevertheless, the right of the human-being is pre-dominant. The research, then, discusses the consequences stemming from the right to the execution of Al-Qazf penalty. The discourse sheds light on multiple questions. The following stand salient: - Dispute in legal suit; - Inheritance in legal suit; complaint and forgiveness; - Reconciliation and surrendering personal right; - Confession of the offender with false accusation; - Implementation of had penalty; - Remission of had penalty through repentance of the person giving false accusations. The present research, in its conclusive sections, provides illuminating discussion by incorporating pertinent quotes of various jurists.
